Terms of Service
Refunds
Due to the nature of our work, given that once work is done the time, effort, and expertise is already expended and cannot be recovered. For this reason we do not provide refunds. We also do not engage in exchanges, transferring of your account balance to others, discounting, partial appeals, or negotiations. We do not negotiate our prices or our terms.
Process
We provide a creative brief form that you will complete. This should give us all information we need to complete the project or order to specifications. All materials and information required are to be submitted with the brief. We will not begin work until all dependencies are received and they are adequate to our needs. We cannot be held responsible for quality of output if we are given poor quality materials and specifications to work with. You will be allowed two reviews with revisions and deliverables provided online.
Reviews
We allow two reviews on all work. We will provide you access to online content for review which you can markup and comment on online for our revision. We require reviews to be done within two business days of request. You will notify us when the review is complete with approved or approved pending these changes. Upon revision you will complete the second and final review. Provide any changes you want. If there are changes we will resubmit, but there are no more revisions included at this point. We then deliver your product to you by electronic upload and you can download as many times as you like.
Process for Advisement, Coaching, Consulting and Any Sort of Meeting, Conference or Communication
Appointments are to be made by you online (we will give you access). We conduct appointments on time. You are charged for the time scheduled and for any extra time used. All time and extras must be paid in advance and are deducted from your balance.
Extras
Project times, and extra time used the project deadline is pushed back by the amount of times estimated for the requests. The costs incurred by extras must be paid in advance and the amount used is deducted from your balance. Extras are overage include time, communication, and work that is in excess of your original purchase.
Project Estimates and Time
The amount of time allotted for your project generally does not include conversational, advisement, consulting, or meeting time, unless you have specifically purchased that. You can always purchase more time online, at any time.
Right to Refuse
We strive to serve our clients with integrity and provide excellent service and quality that they and we can be proud of. We want all of our clients to be exceptionally happy! Unfortunately you can’t please everyone and to maintain our standards we have limits to the amount of work we accept and the type of work. As such we reserve the right to refuse any request, project, service, or client.
Licensing
When a client commissions a custom product the product and all rights belong to the client. The client is to supply all media used in its production, and the client attests that the client own or has legal license to that media. If we are procuring outside media for the client, the client subsumes the use license for that media. The client must pay the expense of any media procured for the client, as applicable.
If the client purchases our material, we retain the license for the material. The client has a license to use the material commercially. If the client pays us to customize our purchased material, then ownership and license transfers to the client, but not the original material.
Hold Harmless
All parties hereby covenant and agree to: (1) indemnify and hold Holder harmless from and against all claims, injuries, suits and damages arising out of the performance by Holder of its duties; (2) not to sue Holder for any decision of Holder to disburse earnest money in accordance with this Agreement.
